Public offer to conclude a donation contract
1. Significance of this Public Offering
1.1. This public offering (the "Offer") is an offer by Bogdan Safonov's public benefit charity Fund "Movement to Achievement" ("Fund"), whose details are set out in clause 5 of the Offer, to enter into a donation agreement (the "Contract") with any person who responds to the Offer ("Donor") for the statutory purposes of the Fund, on the terms and conditions set out below.
1.2. The offer is a public offer in accordance with Article 437.2 of the Civil Code of the Russian Federation.
1.3. The Offer becomes valid from the day following the day of its placement on the Fund's Website at the address: fundbs.com.
1.4. The Offer is valid indefinitely. The Fund has the right to cancel the Offer at any time without giving any reasons.
1.5. The Offer can be amended and supplemented, which come into force from the day following the day of their posting on the Fund's Website.
1.6. The nullity of one or more terms and conditions of the Offer shall not invalidate all other terms and conditions of the Offer.
1.7. The offer is applicable throughout the entire territory of the Russian Federation.
2. Material terms and conditions of the Contract
2.1. Under this Contract the Donor transfers as a voluntary donation his own funds in any of the ways specified in clause 3.2, and the Fund accepts the donation and uses it in accordance with the statutory objectives of the Fund.
2.2. The transfer of funds to the Fund under this Offer is a donation in accordance with Article 582 of the Civil Code of the Russian Federation. The transfer of the donation indicates the consent of the Donor to the terms and conditions of the Offer.
2.3. Amount of the donation: the amount of the donation is determined by the Donor.
2.4. Purpose of the donation: implementation of the statutory goals of the Fund.
3. Procedure for concluding the Contract
3.1. The Contract is concluded by acceptance of the Offer by the Donor.
3.2. The Offer may be accepted by the Donor in any of the following ways:
3.2.1. By transferring money by the Donor in favor of the Fund by payment order to the details specified in paragraph 5 of the Offer, indicating "donation for statutory activities" or "donation for the implementation of the Charity Program" in the line: "purpose of payment", and also using payment terminals, plastic cards, electronic payment systems and other means and systems that allow the Donor to transfer funds to the Fund;
3.2.2. by placing cash (banknotes or coins) in boxes (boxes) for collecting donations, installed by the Fund or third parties on behalf and in the interests of the Fund in public and other places.
3.3. Any of the actions stipulated in paragraph 3.2 of the Offer shall be deemed to be an acceptance of the Offer in accordance with paragraph 3 of Article 438 of the Civil Code of the Russian Federation by the Donor.
3.4. The date of acceptance of the Offer and accordingly the date of conclusion of the Contract is the date of receipt of funds from the Donor to the settlement account of the Fund, and in the case provided for in clause 3.2.2 - the date of withdrawal of funds from the box (box for collection of donations) by authorized representatives of the Fund.
4. Other terms and conditions
4.1. By committing the actions provided by this Offer, the Donor confirms that he/she is familiar with the terms and text of this Offer, the purposes of the Fund's activities, the Charity Program, is aware of the significance of his/her actions, has full right to perform them and fully accepts the terms of this Offer.
4.2. This Offer is governed by and shall be construed in accordance with the laws of the Russian Federation.
4.3. Procedure for concluding the Contract, changing its terms and conditions.
4.3.1. This Contract is a deed of adhesion in accordance with Article 428 of the Civil Code of the Russian Federation. The terms and conditions of the Contract are accepted by the Donor by acceding to the Contract as a whole. The Donor confirms that the Contract does not contain onerous conditions for him/her, which he/she would not accept if he/she had the opportunity to participate in determining the Contract conditions.
4.4. Consent to personal data processing.
4.4.1. By making a Donation, the Donor gives his/her consent to the Fund's processing of his/her personal data, which includes (depending on the method of transferring the Donation): surname, name, patronymic, residence address, telephone number, e-mail address.
4.4.2. The Fund processes personal data of the Donor for the purpose of execution of this Contract, as well as for informing the Donor about the activities of the Fund.
4.4.3. The Fund undertakes not to disclose to third parties and not to disseminate the personal data of the Donor without his/her written consent, except for cases when this information is required by state authorities with relevant powers, as well as cases when the Fund entrusts a third party to perform actions on behalf of the Fund in relation to the Donor, which inevitably include the use of personal data.
4.4.4. The Donor gives consent to the processing of personal data for an indefinite period of time. The consent may be withdrawn at any time by sending a letter to the address (email address) of the Fund specified in Section 5 of the Contract. In case of withdrawal of consent, the Fund undertakes to destroy or anonymize the personal data of the Donor within five working days.
4.4.5. The donor also agrees to receive information from the Fund about the use of the donation, programs and important events of the Fund through electronic, postal and SMS mailings. The Donor may refuse to receive such information at any time by notifying the Fund in writing (by e-mail) of his/her unwillingness to receive such information.
4.5. The Fund confirms that it assumes complete responsibility for the payment of taxes and other property liabilities, the obligation to pay which may arise in connection with the receipt and use of the Donation, including in connection with the misuse of funds.
4.6. The Fund does not have any obligations to the Donor other than the obligations set forth in this Contract.
4.7. All disputes and disagreements under this Contract shall be settled by the Parties through negotiations. In case the Parties cannot reach an agreement, all disputes and disagreements shall be resolved in court in accordance with the laws of the Russian Federation.
